Terms of Service

These Terms of Service ("Terms") govern your use of FatigueOS, operated by Nexbhullah LLC ("we," "us"). By using FatigueOS, you agree to these Terms.

1. Service description

FatigueOS is a SaaS tool that analyzes Meta Ads, TikTok Ads, and Google Ads performance to detect creative fatigue and generate replacement ad creatives via AI.

2. Eligibility

You must be at least 18 and have authority to bind any business you represent. By connecting an ad account, you confirm you have the right to authorize FatigueOS to access it.

3. Account & subscription

  • Plans: Starter ($79/mo), Growth ($199/mo), Agency ($499/mo)
  • Subscriptions auto-renew until canceled
  • Cancel anytime from your account dashboard - access continues through the end of the paid period
  • 14-day free trial; no charge if canceled before trial ends
  • Founding-member lifetime deals are non-refundable after 7 days

4. Acceptable use

You will not:

  • Use FatigueOS to violate Meta, TikTok, or Google ad policies
  • Reverse-engineer, scrape, or resell the Service
  • Connect ad accounts you are not authorized to manage
  • Use the Service to generate ads that violate any platform's content rules (illegal goods, hate speech, deceptive claims, etc.)

5. AI-generated content

Creatives generated via FatigueOS are produced by third-party AI models. You are responsible for reviewing all generated content before launching ads and for compliance with applicable advertising laws. We make no warranty regarding ad performance.

6. Intellectual property

You retain ownership of your data, brand assets, and generated creatives. We retain ownership of the FatigueOS platform, code, and analytics methodology.

7. Refunds

  • Monthly subscriptions: pro-rata refund within first 14 days only
  • Annual subscriptions: full refund within first 30 days
  • Lifetime deals: refund within 7 days

8. Disclaimer of warranties

FatigueOS is provided "AS IS." We do not guarantee specific advertising results, ROAS improvements, or fatigue detection accuracy. Ad performance depends on many factors outside our control.

9. Limitation of liability

To the maximum extent permitted by law, our total liability is limited to the amount you paid in the 12 months preceding the claim. We are not liable for indirect, consequential, or punitive damages, including lost profits or ad spend losses.

10. Indemnification

You agree to indemnify Nexbhullah LLC against any claims arising from your misuse of the Service or violation of these Terms.

11. Termination

We may suspend or terminate your account for violations of these Terms. You may cancel anytime.

12. Governing law

These Terms are governed by the laws of the State of Wyoming, USA. Disputes will be resolved in Wyoming state or federal courts.

13. Changes

We may update these Terms. Material changes will be emailed at least 14 days in advance.
